The Ducky Derby 2015

Rules and Regulations



  1. An approximate number of 30,000 ducks will be entered in the race by the Rotary Club of Aspen as "Presenter".
  2. Ducks will be launched in the Roaring Fork River from No Problem Bridge at Herron Park, Aspen, CO at 2:15 pm on Saturday, August 8, 2015. The finish line will be below the Mill Street Bridge at the Rio Grande Park. The race course will be established by the Presenter. The Presenter reserves the right to manually maneuver ducks up or down the course in order to expedite all ducks finishing the race. The Presenter reserves the right to conduct the race in an alternative location and/or format if, in the sole judgment of the Presenter, the river conditions will not allow the race to be run on the river.
  3. All ducks entered will be provided by the Presenter and shall remain the property of the Presenter.
  4. Once the ducks are launched, they are on their own. No attempt to free or interfere with any duck is permitted, except as provided for in Paragraph 2 above, and unless deemed necessary by the Presenter's designated Race Committee. The race course will close 20 minutes after the first duck has crossed the finish line and/or is caught in the duck trap.  Any ducks finishing after that time will not be eligible for the prizes or the Lucky Duck Promotion.
  5. Coded numbers will be attached to each duck, and assigned to a number on an adoption paper. Multiple duck entries from one adoption paper will be assigned additional duck numbers for identification. The person’s name that appears on the adoption paper corresponding to the ducks in order of finish will be awarded a prize by Presenter.  Positive identification will be required to claim any prize won.
  6. The Presenter reserves the right, at its sole option, to substitute prizes of comparable value. A prize may be subject to change prior to the race event.
  7. The combined retail value of all prizes will be over $10,000.
  8. The entry portion of each adoption paper must be completely filled out and delivered to Presenter at P.O. Box 1527, Aspen, CO 81612, or on the day of the race, at Presenter's regular place of selling adoption papers in the City of Aspen no less than forty-five (45) minutes before the start of the race to be eligible to win a prize. Entrants assume the risk of non-delivery or tardy delivery of entries.  For any entry which, for any reason whatsoever, is not assigned a duck in the race, the sole remedy for such entry shall be the refund of the entrant's donation.
  9. The Presenter reserves the right to limit the number of duck adoptions per individual.
  10.  Each duck adopted for entry into the race requires a donation to benefit Roaring Fork Valley organizations and other entities selected by the Presenter.
  11.  Prize winners will be announced approximately one hour following the race.  Entrants will be notified by United States mail or by telephone. Race winners need not to be present to win. If any prize winner (other than a Lucky Duck Promotion winner) does not claim his or her prize from the Presenter at the address listed in paragraph eight (8) above within 30 days after August 8, 2015 the Presenter will select another winner based upon the order of finish of ducks.
  12. All prizes will be awarded.  Officers, directors, and members of Presenter, as well as resident family members of the same, shall be ineligible to win prizes exceeding $100 in value.
  13.  Any and all taxes on any prize or amounts paid in connection with the Lucky Duck Promotion are the sole responsibility of the winner.
  14.  By entering, entrants release the Presenter and its officers, directors, members, staff and other related entities from any and all liability with respect to prizes, the Lucky Duck Promotion, the race, and the festival.
  15.  Chances of winning depend on the total number of qualified entries.
  16.  All decisions and interpretations of rules and regulations will be made by Presenter and its judgment is final.
  17.  The race  is subject to all federal, state and local laws and regulations and is void when prohibited by law.
  18. The race shall include a "Lucky Duck Promotion" whereby $1,000,000 will be awarded to the adoption paper corresponding to the first duck to cross the race finish line and/or is caught in the duck trap, provided that the number on such duck matches in exact sequence one or more pre-selected winning numbers, which winning numbers shall not be disclosed to Presenter or race participants until after the race.  Presenter has engaged a third party risk coverage provider ("RCP") with respect to payment of the $1,000,000 amount in connection with the Lucky Duck Promotion, and payment of any amount in connection with the Lucky Duck Promotion shall be subject to the terms and conditions of Presenter's contract with Presenter's RCP.
  19. Officers, directors, and members of Presenter, as well as resident family members of the same shall be ineligible to participate in the Lucky Duck Promotion and shall be ineligible to win the Lucky Duck Promotion.
  20.  Names and likenesses of the Lucky Duck Promotion winner may be used by the Presenter, Presenter's RCP,  and their designee(s) for promotional purposes without further compensation to the  Lucky Duck Promotion winner(s).
  21.  The $1,000,000 amount awarded in connection with the Lucky Duck Promotion is payable in increments of  $25,000 over 40 years without interest.
